BAYVIEW CROSS CASE

The case of the cross at Bayview Park in Pensacola park will go before the U.S. Court of Appeals next week. It began in 2016 when the American Humanist Association and the Freedom From Religion Foundation filed a lawsuit against the City claiming the cross at Bayview Park violated the constitutional right of separation of church and state. A federal court ruled the cross unconstitutional in June 2017 and ordered it be removed. The City of Pensacola appealed that order in September 2017 and the removal order was suspended. On Wednesday, May 16th, arguments will be presented in the 11th Circuit Appeals Court.
