BAYVIEW CROSS LAWSUIT

The U.S. Supreme Court has ruled that a 40-foot cross on government property in Bladensburg, Maryland, – that was erected as a World War I memorial a century ago – can remain standing. That decision may have implications for the lawsuit involving the cross at Bayview Park in Pensacola.  The American Humanist Association and the Freedom From Religion Foundation filed a lawsuit against the city in 2016 on behalf of four residents who wanted the cross to be removed. The U.S. District Court judge ruled the cross violated the Constitution’s Establishment Clause and had to be removed. The case went to the U.S. 11th Circuit Court of Appeals, which upheld the lower court’s ruling. The lawsuit is pending before the U.S. Supreme Court, which is expected to take action on the case in the next few days.
