A bill has been filed in the Florida Legislature to repeal the ban on consumers purchasing recreational fireworks and would allow the sale of fireworks on Independence Day and New Year’s Eve. A current loophole in Florida law allows bottle rockets and Roman Candles to be purchased to scare birds away from crops and fish hatcheries and to mark a railroad crossing and quarrying. However, a 2002 court ruling found there’s no requirement for a fireworks dealer to determine if the buyer is telling the truth when they check a box on a form that they intend to use fireworks for legal purposes. Efforts to legalize fireworks in Florida have been on-going since 2013.
