A Leon County Circuit Judge has approved a motion to dismiss a lawsuit to force Florida Governor Ron DeSantis to close all state beaches. The Governor’s deputy general counsel argued that the governor has legal discretion in deciding how he uses his emergency powers during the coronavirus pandemic and the judge agreed. However, he also urged plaintiff’s attorney Daniel Uhlfelder, (“U-Felder”) to take the case to the First District Court of Appeal for review to see if his ruling is wrong. At least 34 counties have closed their beaches since mid-March, but in some communities, people are allowed to surf, swim, fish, hike and jog.
