The Florida Supreme Court has decided to allow capital cases to go forward. In October, the High Court ruled that anything short of unanimity among jurors in death penalty cases was unconstitutional, and there has been a moratorium on executions in Florida since. State statutes currently require a 10-2 majority among jurors for death to be imposed and the Court has ruled the current statute can be applied as long as jurors are instructed their findings have to be unanimous.
