FISH HATCHERY LAWSUIT DISMISSED

A lawsuit challenging the Florida Fish and Wildlife Conservation Commission’s lease with Pensacola for the planned fish hatchery in downtown Pensacola has been dismissed. Circuit Court Judge W. Joel Boles ruled the two downtown property owners, Dan Lindemann and Jerry Holzworth, did not have standing to sue the city and the FWC over the lease for the hatchery. Lindemann and Holzworth asked the Court to declare the lease between the city and FWC void since construction of the hatchery did not begin within the required time. Judge Boles said the two did not demonstrate a “special injury” they would suffer that is required to bring a lawsuit against the state.
