The Pensacola News Journal is reporting that Circuit Court Judge W. Joel Boles has granted a motion to allow the two downtown property owners behind the lawsuit over the planned fish hatchery at Bruce Beach to continue with that suit. In November, Dan Lindemann and Jerry Holzworth filed suit over the lease for the Hatchery. Attorneys for the city argued during a hearing on April 3rd that Lindemann and Holzworth did not have standing to sue because they did not demonstrate a “special injury” required to bring a lawsuit in their original complaint. Boles ruled in favor of the city and dismissed the lawsuit. Now the Judge has given Lindemann and Holzworth’s attorney 30 days to file an amended complaint.
